Terms of Service

These Terms of Service (the "Terms") govern your access to and use of the LXM Collection website at lxmcollection.com (the "Site") and any related services, editorial content, lead-capture forms, chat widgets, communications, and introductions provided by LXM STRATEGIES LLC, a Delaware limited liability company ("LXM," "we," "us," or "our"). By using the Site or engaging with our services, you agree to be bound by these Terms.

1. Services

LXM operates an editorial discovery platform for luxury real estate and elevated living. We provide marketing, curation, lead generation, and introduction services primarily to real estate developers in Colombia and other markets, with a focus on connecting them with qualified foreign investors, second-home buyers, and lifestyle clients. LXM is a marketing and introduction service. LXM is not a licensed real estate broker in every jurisdiction in which properties shown on the Site are located, and LXM does not act as your real estate agent, attorney, tax advisor, or financial advisor. Any transaction relating to a property is negotiated and executed directly between you and the developer, seller, or their licensed representatives in the relevant jurisdiction.

2. Eligibility and account use

You must be at least 18 years old and able to form a binding contract to use the Site. When you submit information through a form, chat widget, newsletter, or "Private Access" or "Apply" flow, you represent that the information you provide is accurate, complete, and your own (or that you are authorized to submit it on behalf of the entity you represent).

3. User obligations

You agree not to:

• Use the Site or our services for any unlawful, fraudulent, or harmful purpose.
• Submit false, misleading, or impersonated contact information.
• Attempt to access non-public areas of the Site, our infrastructure, or our partners' systems.
• Scrape, copy, or otherwise systematically extract content, listings, or imagery from the Site without our prior written consent.
• Use the Site to send unsolicited commercial messages or to harass any party introduced through our services.
• Interfere with the integrity, security, or performance of the Site or any third-party services it relies on.

4. Property information; no offer of securities or investment advice

Property descriptions, pricing, renderings, floor plans, amenities, expected returns, completion dates, and other information published on the Site are provided by developers, agents, or other third parties and are believed to be accurate at the time of publication. They are indicative only, may change without notice, and do not constitute an offer to sell, a solicitation of an offer to buy, an offer of securities, a guarantee of return, or investment advice. You are solely responsible for conducting your own due diligence and for engaging independent legal, tax, and financial advisors before entering into any transaction.

5. Intellectual property

The Site and its original content, brand marks, editorial text, photography, illustrations, layouts, code, and design are owned by or licensed to LXM STRATEGIES LLC and are protected by United States and international copyright, trademark, and other intellectual property laws. The marks "LXM Collection," "LXM," and related logos are trademarks of LXM STRATEGIES LLC. Third-party trademarks, including those of partner developments, are the property of their respective owners. You are granted a limited, non-exclusive, non-transferable license to view the Site for personal, non-commercial use; all other rights are reserved.

6. Third-party services

The Site uses third-party services including, without limitation, Netlify (hosting), Supabase (backend / data storage), HighLevel / LeadConnector (chat widget, CRM and SMS delivery), Google services (analytics, fonts, Apps Script webhooks), LiteAPI (accommodations search), and the developers whose listings we feature. Your use of those services through the Site may be subject to their own terms and privacy practices. LXM is not responsible for the content, availability, or practices of those third parties.

7. Communications and electronic consent

When you submit a form, request access, or chat with us, you agree that LXM may contact you by email, phone, or, if you have given us your phone number and opted in, by SMS, in each case in response to your inquiry and to provide information about our services. Marketing communications are sent only with your explicit consent and you can opt out at any time as described in our Privacy Policy and SMS Terms.

8. Limitation of liability

To the maximum extent permitted by law, the Site and all services are provided "as is" and "as available," without warranty of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of information. LXM, its members, officers, employees, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or in connection with your use of the Site or services, the conduct of any third-party developer or counterparty introduced through the Site, or any transaction you enter into based on information found on the Site, even if LXM has been advised of the possibility of such damages. To the extent any liability cannot be excluded, LXM's aggregate liability to you for all claims in any twelve-month period will not exceed the greater of (a) the amounts you paid to LXM during that period or (b) USD 100.

9. Indemnification

You agree to indemnify, defend, and hold harmless LXM STRATEGIES LLC and its members, officers, employees, agents, contractors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the Site or our services; (b) your breach of these Terms; (c) any content or information you submit through the Site; (d) your violation of any law or of any third party's rights; or (e) any transaction or relationship you enter into with a developer, seller, or other party introduced through the Site.

10. Termination

LXM may suspend or terminate your access to the Site or our services at any time, with or without notice, for any reason, including for any violation of these Terms. Sections that by their nature should survive termination (including intellectual property, limitation of liability, indemnification, and governing law) will so survive.

11. Governing law and disputes

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Any dispute, claim, or controversy arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in the State of Delaware, and you and LXM consent to personal jurisdiction and venue in those courts. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

12. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Material changes will be notified through the Site. Your continued use of the Site after a change becomes effective constitutes acceptance of the revised Terms.
